References in these terms and conditions to ‘you’ and ‘your’ means the customer and to ‘us’, ‘we’ and ‘our’ means Magic of Disney Art.
Price Match Guarantee – Magic of Disney Art aims to offer the most competitive pricing. If you find any of our items listed cheaper please contact us and we guarantee to match or beat the price you have found subject to the conditions listed herein. Shopping with us not only offers free, insured UK shipping on all orders over £35 in value, but also lets you make use of our exceptional UK-based customer service, careful and secure packaging and UK-based dispatch system. Please note that this guarantee does NOT apply to items listed on online or offline auction services (such as eBay). However, our price guarantee DOES apply internationally. Using the exchange rates listed on http://www.xe.com/ we will match the price of any item offered by an overseas gallery (plus any applicable VAT that may be payable by UK customers). Please note that, when purchasing items from a company/gallery in the USA, you will be subject to import VAT, duty and handling charges. By purchasing from Magic of Disney Art you ensure that “the price you see is the price you pay” — our items are sent to you from within the UK so you will not receive any nasty surprises or additional fees and charges upon delivery. We reserve the right to restrict or remove our price match guarantee policy at any time, and it applies only to galleries/stores who are officially authorized to sell the items. All items must be directly comparable and identical to those that we offer – i.e. brand new and officially endorsed/authorized products. Items offered for sale in our “Disney Art Archive” are excluded from this policy. If the item in question is framed, the comparable product must be framed in the identical style to what we offer.
Affiliation – We are an independent gallery not operated, controlled or run by the Walt Disney Company. We retail official Disney artwork on behalf of the Walt Disney Company’s authorised publishing studios who produce artwork under licence. Images – The images used on this website are copyright to their respective studio or owners. No images may be copied, saved or otherwise transferred without the express consent of the copyright owners.
Prices – All prices shown are in GB pounds sterling and include any UK VAT that may be payable. Prices exclude delivery charges, although delivery is free for orders above £34.99 in value.
Payment – We accept most major credit and debit cards online through our secure payment processor. Credit card details will be handled securely to ensure confidentiality. 128 bit SSL encryption is employed to ensure sensitive data is protected during transmission over the internet. Lay-Away plan payments are automatically taken on or around the first day of every calendar month.
Gift Certificates / Gift Vouchers –
- Gift certificate validity duration. Gift certificates are valid for a period of 24 months from the date of purchase. They cannot be redeemed after the expiry date.
- Use of promotional codes. Promotional codes and any other vouchers or promotions of any kind cannot be used in conjunction with gift certificates.
- Voucher redemption. Gift certificates can only be redeemed online at our website.
- Refunds. Gift certificates are non-refundable other than within the 14 day cancellation period as per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. No change or credit will be given in the event that the gift certificate value exceeds the total cost of the order – for example where a £100 voucher is used to purchase a £95 art piece.
- Monetary vouchers. Gift certificates can be used for part or full payment of a product only. If the product cost exceeds the amount of the gift certificate, the balance must be paid in full by credit or debit card at the point of ordering.
If we are given an incorrect or incomplete delivery address by you and are charged by our shipping provider when they make the correction, you will be responsible for this charge.
When ordering goods from us for delivery overseas (i.e. outside of the UK) you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Magic of Disney Art, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities. We will not declare a lower-than-actual value on packages.
We use Royal Mail, UPS, FedEx, TNT, Hermes, DHL and Yodel to deliver orders. These couriers may deliver to a neighbour if you are not available when they attempt to deliver your order. We accept no responsibility for any orders that are claimed to have not been received if the courier confirms that it was delivered to a neighbour. If you do not wish to have your order delivered to a neighbour in such circumstances we suggest you ensure all appropriate couriers are notified of this so that your item is returned to the depot if you are not home.
Delivery Times – We ask our customers to allow up to 25 business days for standard delivery within the UK. If you are outside the UK, please allow up to 35 business days for delivery.
IMPORTANT: We do everything we can to meet the delivery times specified in this section. However, occasionally delivery times may be affected by factors beyond our control and therefore they cannot be guaranteed. We will inform you if we become aware of an unexpected delay. These delivery times do not form part of our contract with you. We will not, under any circumstances, be held responsible for delivery delays which lie with the responsibility of the courier or postal service.
All limited edition art pieces are subject to these delivery times as they are individually created “on demand”. Consequently, additional delays may also be inevitable. We will try our best to dispatch your purchase as quickly as possible but these items are individually hand crafted by the studio and delays may result from this process. Please contact us for detailed information on delivery times for specific art pieces.
Ownership of Goods – Ownership of goods will not pass from Magic of Disney Art to you until payment has been received in full.
Complaints Procedure – If for any reason you are not completely satisfied with any aspect of your purchase, please email us on firstname.lastname@example.org . We endeavour to respond to all email enquiries within a maximum of 3 business days.
Refund policy – We want you to be completely happy with your Magic of Disney Art shopping experience. Complying with the Distance Selling Regulations, you may return your purchase within 28 days for receipt of a full refund of the purchase price (minus postage charges). Please note that the item must be in the original condition and still sealed within its original packaging. You are responsible for the return postage costs (unless the return is a result of our error), and we recommend you send any items back to us via an insured, traceable delivery service in case of loss or damage. This refund policy does not affect your statutory or legal rights. Certain items, including custom-framed and/or custom-ordered special limited edition fine art and limited edition studio art pieces will be subject to a discretionary restocking and service charge of up to 20% of the total order value. This fee is non-refundable and will reflect the expenses we incurred in connection with the performance of your order. Some special/custom ordered items are NON REFUNDABLE and we cannot accept returns – this includes all custom-produced hand-embellished fine art giclees and pieces of art ordered with custom-styled studio framing, in addition to specially ordered pieces or pieces sold by a private seller via Magic of Disney Art as an intermediary. All limited edition art that has been framed is non-returnable, as this framing is completed on a bespoke and custom/individual basis for you. You cannot complain that you do not like the frame style if you did not contact us before placing your order to verify the frame style that your art piece is framed in.
If you cancel a Lay-Away plan more than 7 days after it is set-up (and after making a payment) we will deduct a 20% administration fee from the amount refunded to you to cover our shipping, administration and packaging costs in ordering and storing your artwork.
Damages – For limited edition items, you MUST sign for your delivery as “unchecked” or “damaged” if you have not physically opened the box and reviewed the artwork, in front of the courier deliverer, to ensure it is not damaged. We cannot accept liability for any damaged orders if you have failed to sign for the delivery as “unchecked” or “damaged”. If you have signed for your order as “unchecked” or “damaged”, and the order is damaged, we will refund your order in full – or send a replacement – within 14 business days of receiving the damaged order back to us. Your return postage costs will be refunded and there will be no additional postage charges for sending the replacement. However, you must notify us of your damaged order within 48 hours of it being delivered. After this time, any replacement or refund is at our discretion and may include a service charge reflecting our costs in connection with the performance of your order.
Cancellation Policy – Our customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item has been delivered. To cancel your purchase within the seven working day cooling-off period, please email us at email@example.com – and we will then issue you with a returns authorisation code.Please package the relevant item(s) securely and send it to us with your returns authorisation code number so that we receive it within seven working days of the day after the date that we issued you with the returns authorisation code. Please note that we cannot accept returns if you deliver them to us by hand. For your protection, we recommend that you use an insured delivery service. We are not responsible if the item gets lost in a postal system. FRAMED ITEMS AND INDIVIDUALLY ORDERED CUSTOM-STYLED LIMITED EDITIONS AND FINE ARTWORK ARE EXCLUDED FROM THIS POLICY.
Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged, defective or different to the item ordered. If we do not receive the item back from you with the delivery slip, we may arrange for the collection of this from your residence – at your cost.
As soon as we receive notice of your cancellation of this order, we will refund the purchase price for that item together any delivery charges you have paid to us. Refunds will be made via a credit refund back to the credit or debit card used for the purchase. Refunds cannot be made via cash or cheque.
ERRORS – We reserve the right to not complete a transaction if an error has been made regarding the pricing of any item(s). If this is the case, we will refund your order in full within 72 business hours. In addition, item(s) which are sold out and/or retired may still display on our website even after they are no longer available. Any customer purchasing such an item(s) will be refunded in full within 72 hours, and their contract to purchase will be cancelled.
Magic of Disney Art reserve the right to cancel any order at any time. A full refund (including any postage and packaging charges) will be made to the customer when the order is canceled by us.
Please note that all pictures of framing are for illustration purposes only. Exact framing styles may differ. Artist signature may not appear if studio framing requires the edge of the paper to be covered by matting – request if you do not want this.
Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. We reserve the right to refuse access to our website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.
These terms and conditions and all transactions relating to our website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts.
